(Order No. 28 of the State Electricity Regulatory Commission) Measures for the Administration of Electric Power Facility Installation (Repair, Testing) Licenses
Article 6: Licenses are divided into three categories: installation, repair, and testing.
Those who obtain an installation license may engage in installation activities of electric power facilities.
Those who obtain a repair license may engage in repair activities of electric power facilities.
Those who obtain a testing license may engage in testing activities of electric power facilities.
Article 7: Licenses are divided into five levels: Level 1, Level 2, Level 3, Level 4, and Level 5.
Those who obtain a Level 1 license may engage in installation, repair, or testing activities of electric power facilities at all voltage levels.
Those who obtain a Level 2 license may engage in installation, repair, or testing activities of electric power facilities with voltage levels below 220 kV.
Those who obtain a Level 3 license may engage in installation, repair, or testing activities of electric power facilities with voltage levels below 110 kV.
Those who obtain a Level 4 license may engage in installation, repair, or testing activities of electric power facilities with voltage levels below 35 kV.
Those who obtain a Level 5 license may engage in installation, repair, or testing activities of electric power facilities with voltage levels below 10 kV.
Chapter 3: Application, Acceptance, Review, and Decision
Article 8: An application for a license shall be submitted to the dispatched agency at the location of the applicant.
Only after obtaining the license can the applicant apply to the administrative department for industry and commerce for a business license or change the business scope.
Article 9: To apply for a license, the following conditions shall be met:
(1) Having legal person qualification;
(2) Having registered capital commensurate with the applied license category and level;
(3) Having equipment and business premises commensurate with the applied license category and level;
(4) The technical director and safety director shall have qualifications commensurate with the applied license category and level, and shall not hold positions in other units simultaneously;
(5) Having full-time professional personnel commensurate with the applied license category and level;
(6) Having a sound and effective safety production organization and system.
For applications for Level 1 to Level 3 licenses, the applicant shall also have performance commensurate with the applied license category and level.
The specific application conditions for different categories and levels of licenses shall be formulated separately by the State Electricity Regulatory Commission and announced to the public.
Article 10: To apply for a license, the following materials shall be submitted:
(1) License application form;
(2) Legal person certification materials and net asset certification materials;
(3) List of main equipment and tools, and certification materials for business premises;
(4) Resumes of the technical director and safety director, and certification materials such as professional technical qualification certificates;
(5) Detailed list of professional technical personnel, and certification materials such as professional technical qualification certificates or training qualification certificates;
(6) Registration form for electrician operators;
(7) Certification materials for safety production organization and system.
For applications for Level 1 to Level 3 licenses, relevant performance reports and certification materials shall also be submitted.
Article 11: For a newly established unit after merger applying for a license, in addition to the materials specified in Article 10, the following materials shall also be submitted:
(1) Certification materials for the merger;
(2) Licenses of each unit before the merger.
Article 12: For a newly established unit after division applying for a license, in addition to the materials specified in Article 10, the following materials shall also be submitted:
(1) Certification materials for the division;
(2) Performance certification materials;
(3) License of the unit before the division.
After the division, at most one unit may partially or wholly continue the performance of the pre-division unit in similar activities.
Article 13: Upon receiving an application, the dispatched agency shall review whether the application materials are complete and conform to the statutory form. The dispatched agency has the right to require the applicant to explain or clarify the application matters.
Article 14: The dispatched agency shall handle the application submitted by the applicant according to the following circumstances:
(1) If the application materials contain errors that can be corrected on the spot, the applicant shall be allowed to correct them on the spot;
(2) If the application materials are incomplete or do not conform to the statutory form, a notice of correction of application materials shall be issued to the applicant on the spot or within five days, and all the contents that need to be corrected shall be notified at one time;
(3) If the application materials are complete and conform to the statutory form, or the applicant submits all the corrected application materials as required by the dispatched agency, a notice of acceptance shall be issued to the applicant.
